Terms of service

Last updated 21 October 2026

These terms are the agreement between your business and Foan Pte. Ltd. ("Foan", "we", "us") for using Foan. They cover the website, the dashboard, the API, the MCP server, the command line tool and plugins, phone numbers, the chat widget and anything else we provide under the Foan name. By creating an account or using Foan you accept these terms. If you accept them for a company, you confirm that you are allowed to bind that company.

1. The service

Foan is a platform that lets businesses build AI agents that answer and make phone calls and hold chats on the web and in messaging apps. Foan is for business use. It is not a consumer product, and it is not a phone company: calls are carried by licensed telecom carriers that we work with.

If your business has signed a separate agreement or order form with us, that document applies together with these terms, and it wins where the two disagree.

2. Your account

3. AI voices and AI output

Foan agents speak with AI-generated voices, including custom voices built from recorded voice samples. They are not recordings of a live person. You accept this, and you are responsible for giving your callers and contacts any notice that the law or your own policies require, for example that they are speaking with an automated agent or that the call is recorded.

Only create a custom voice from a person's voice if that person has given you clear permission to do so.

AI can make mistakes. An agent can mishear a caller, misunderstand a question or say something inaccurate. Test your agents before you put them in front of customers, review important results, and do not rely on an agent for medical, legal, financial or other professional advice, or for decisions that seriously affect a person without a human checking them.

Foan agents cannot place or handle emergency calls. Do not set up an agent as a way for anyone to reach emergency services, and make sure your callers have another way to reach a person when they need one.

You decide who your agents call or message and what they say. Foan records calls and keeps transcripts so that you can review them. You are responsible for using all of this lawfully. In particular you must:

For the personal information of the people your agents talk to, you are in charge of that information and we process it on your behalf and on your instructions, as described in our privacy policy. Foan gives you tools; we cannot know your legal position, so take your own advice if you are unsure.

5. Acceptable use

You must not use Foan, or let anyone else use it, to:

If we believe an account, number, agent or campaign breaks these rules, or puts people, our carriers or other customers at risk, we can pause or limit it, in urgent cases without notice. We will tell you why where we are able to. If you think we got it wrong, write to us and we will look again.

6. Phone numbers

Phone numbers you get through Foan come from our telecom partners. You can use them while your account is in good standing, but you do not own them. Some numbers need business verification documents before they can be activated, and you must give true documents. We may have to change, suspend or take back a number if a carrier or regulator requires it, if the number is misused, or when your account or plan ends. Carriers and phone apps can also block calls or label them as spam on their own; that is outside our control.

7. AI tools and connectors

You can connect Foan to AI assistants such as Claude, ChatGPT and Codex, and to other tools that support the Model Context Protocol. When you connect one, you let it act on your Foan account with the access you approve. Actions that spend money or are hard to undo ask for your confirmation first, and you are responsible for the actions you or your tool confirm.

Those tools are run by other companies under their own terms and privacy policies. We are not responsible for how they work or what they do with information you give them. You can disconnect a tool at any time.

8. Plans and payment

Some parts of Foan are paid through a plan, and usage such as call minutes and chat messages is paid from a prepaid balance. Current prices are shown in the dashboard and on our pricing page. Taxes are added where the law requires.

9. Your content

You keep ownership of everything you put into Foan, including agent instructions, knowledge documents, contact lists and the content of your calls and chats. You give us permission to host, copy and process that content only as needed to run Foan for you, to keep it secure, and to meet the law. We do not use your content to train AI models.

We may use statistics about how the platform is used, combined and with personal details removed, to run and improve Foan. If you send us feedback or ideas, we may use them without owing you anything.

10. Our platform

Foan, our software, our website and our brand belong to us. Apart from the right to use Foan under these terms, you get no rights in them. Features labelled as beta, preview or trial are offered as they are, may change or stop, and may not be as reliable as the rest of Foan.

11. Availability and changes to the service

We work hard to keep Foan running, but we cannot promise it will always be available or work without errors. Calls and messages depend on carriers, AI model providers and other services outside our control. We improve Foan all the time, so features can change. If we remove something important you rely on, we will try to tell you in advance.

12. Suspension and closing your account

You can stop using Foan and ask us to close your account at any time by writing to dhruv@foan.ai. Before you close it, export anything you want to keep, such as call results and transcripts.

We can suspend or end your access if you break these terms, do not pay, or use Foan in a way that risks harm or legal trouble for people, for us or for our partners. Where we can, we will warn you first and give you a chance to fix the problem.

When your account ends, your right to use Foan ends, and we handle your data as our privacy policy describes. Anything you owe us stays payable, and the parts of these terms that by their nature should continue (such as payment, liability, indemnity and governing law) continue.

13. Disclaimer

Foan is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those written in these terms, including any implied promise that Foan will suit a particular purpose or that AI output will be accurate.

14. Limits on liability

To the extent the law allows:

Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud.

15. Indemnity

If anyone brings a claim, complaint or fine against Foan because of your content, your contact lists, your calls or messages, how you use Foan, or your breach of these terms or the law, you will cover our resulting losses, fines and reasonable legal costs. We will tell you about the claim promptly and let you take part in handling it.

16. Governing law and disputes

These terms are governed by the laws of Singapore. If a dispute comes up, write to us first and we will both try in good faith to settle it within 30 days. If we cannot, the courts of Singapore have exclusive jurisdiction. This does not take away rights that the law of your country gives you and that cannot be changed by contract.

17. General

18. Changes to these terms

We may update these terms from time to time. When a change matters, we will update the date at the top and tell account owners by email or in the dashboard before it takes effect. If you keep using Foan after a change takes effect, you accept the new terms. If you do not agree, stop using Foan and close your account.
